Building Blocks: Hill v Tupper [1863]

In this Building Blocks episode, Richard discusses the characteristics, and the requirements to qualify as an easement with regards to Hill v Tupper. Hill was granted exclusive and contractual rights to run pleasure boats along a canal, but Tupper was also running boats along the same stretch of canal; albeit for the purpose of allowing people to fish and bathe in it. Hill objected to this. However, it was asserted that easements must be for the benefit for the dominant land, and so Richard describes the implications and outcome of the case with regards to this.
